Max is an associate solicitor in the trust and estate disputes team and advises on a range of matters including:

  • will disputes
  • claims under the Inheritance (Provision for Family and Dependants) Act 1975
  • executor disputes
  • trust and trustee disputes
  • matters arising under the Trusts and Trustees of Land Act 1996 (TLATA)
  • Estate dispute: acting for the administrator and beneficiary of an estate in four separate sets of proceedings. We have successfully defended claims under the Inheritance (Provision for Family and Dependants) Act 1975, a claim to propound a forged will and a claim in the Court of Appeal by the deceased’s cohabiting partner for a greater beneficial interest in the deceased’s property.
  • Will dispute: instructed by a child of the deceased who had been disinherited. Pursued a claim that the will was invalid due to undue influence and lack of testamentary capacity. Following disclosure of medical records and witness evidence it was agreed our client would receive a substantial settlement sum.
  • Inheritance Act: obtained a substantial settlement sum for the child of the deceased who had been disinherited. Reached a speedy settlement with the beneficiary of the estate at limited cost to our client.
  • Administration dispute: obtained a favourable resolution for two children of the Deceased, one of whom is a public figure. The executor was exaggerating their expenses and trying to force our clients to agree an unfavourable distribution of the estate on the basis of an unsubstantiated agreement. We issued proceedings in the High Court and obtained an order compelling the executor to pay the estate funds into Court. The executor ultimately agreed to distribute in accordance with the intestacy rules, reduced their expenses and paid our clients’ costs.
  • Property trust: acted for a sibling with a beneficial interest in a property occupied by his sister. She was refusing to sell. Issued proceedings seeking an order for sale and obtained a six-figure settlement sum and a substantial contribution to our client’s costs.
