Introduction
Within the UK there has been a steady increase in life expectancy and old age brings with it a range of problems and concerns. There are also a number of people incapable of managing their own financial affairs for reasons such as dementia or due to an accident.
Russell-Cooke has a specialist team experienced in dealing with matters affecting the elderly and incapable. In particular, we have extensive knowledge of dealing with Enduring Powers of Attorney and Court of Protection work.
Lasting powers of attorney (LPA)
An LPA is a legal document enabling you (the Donor) to appoint an attorney(s) to manage your financial affairs. In order for an LPA to be legally effective, the person making it must have the required mental capacity to create it.
If you do not have any friends or family who you wish to appoint as your attorney, you may wish to consider appointing Russell-Cooke Trust Company. It is non-profit-making company, regulated by the Law Society and covered by the firm's professional indemnity policy.
We also act for attorneys, assisting them registering the LPA as soon as the Donor (who made the LPA) becomes or is becoming mentally incapable and helping with general financial administration. This is particularly useful where the attorney(s) live(s) abroad or a long distance from the Donor.

Enduring Powers of Attorney and Lasting Powers of Attorney
An update on the new regime of Lasting Powers of Attorney (LPAs), which will replace the existing Enduring Powers of Attorney (EPAs).
Court Of Protection
Our team is experienced in dealing with all aspects of Court of Protection work including property transactions and Statutory Wills.
If a person loses mental capacity, and has not appointed an attorney, a Receiver is appointed to manage their financial affairs. The Receiver is usually a family member. However, in the case where there is no one willing or suitable to act, a professional Receiver is appointed. Richard Frimston is a member of the Public Guardianship Office’s Panel of Receivers and acts as a professional Receiver in a large number of cases. The department has specific record keeping systems in place to assist with this type of financial management.
We also act for family members by assisting them in making applications to the Court to be appointed as Receiver. Further, we can assist Receivers who have been appointed, where they require assistance with specific legal issues, preparing accounts for the Court and general financial administration.
