Introduction
The Professional Regulation Department has a substantial caseload, reflecting the firm's growing reputation and high level of specialist experience in this area.
It is headed by Peter Cadman, a senior partner of the firm and experienced criminal defence lawyer whose work has included complex fraud and DTI cases.
Background
We advise and represent clients on any matter relating to the codes of conduct which regulate the professions or are laid down or enforced by statutory bodies.
Defence cases undertaken on behalf of individuals and firms make up a large proportion of our caseload. These can range from technical breaches of the rules to serious allegations of dishonesty requiring hearings over many days.
We also have considerable experience of investigatory or prosecution work for the governing authorities themselves, including a large number of cases undertaken on behalf of the solicitor's governing body, the Law Society.
Where disciplinary tribunals commit errors of law or procedure they may be challenged by application to the High Court by way of judicial review. The firm has extensive experience both in bringing and defending judicial review cases.
People
Peter Cadman heads the department. He has represented solicitors, accountants and doctors before their professional bodies and is retained by the Law Society and the Architects' Registration Panel to conduct matters on their behalf.
He is an experienced advocate and has full rights of audience in all courts.
Other Russell-Cooke partners and solicitors have relevant expertise and become involved in casework on an ad hoc basis.
