Increasing numbers of local planning authorities now have Community Infrastructure Levy (CIL) charging schedules in place meaning that development in those areas is subject to CIL.
Especially in areas where CIL charging schedules are new, we are finding that client’s agents are making errors in the CIL process that can end up with charges which could have been avoided. Equally, local planning authorities are sometimes failing to send out the CIL notices required of them, which might otherwise have prompted clients to request reviews to get matters corrected, and thus clients are missing out on opportunities to claim appropriate reliefs.
We have created a simple flow diagram which can be used as a checklist to minimise the risk of those errors. In the event that errors have been made, all is not lost, as local planning authorities still have discretion to amend CIL demand notices.
