We have acted for the Executors and Trustees of an English Will in dealing with the French property held by a deceased and which formed part of a discretionary trust by virtue of the Will. There was a desire to sell the property as soon as possible as it was deteriorating.

Trusts are generally recognised under French law and as a concept they are not readily understood by the French who often view them with some mistrust. A stalemate had been reached between the notaire appointed to deal with the French succession and the Executors and Trustees and their advisers as to how to proceed.

We were able to propose a solution after due consideration of the French and UK legal and tax consequences and we then went on to assist the notaire in providing the necessary information to permit its implementation. The property could then be sold.
