Direct marketing campaigns and the data protection pitfalls

A common issue for charities is whether your organisation has permission to send marketing information to individuals or to pass on their personal information to other organisations. To ensure data protection rules are adhered to, the best approach is to be able to show from your records that you obtained consent from the individual and that such consent was knowingly given, clear and specific.

The Charity Commission continues to get even tougher

Paula Sussex, the Commission’s new Chief Executive has stated that the Commission is going to ‘get tougher on itself and tougher on those charities that fail to comply with the law’. The Commission has already taken a number of steps to strengthen its regulatory powers and reach.

Law Commission consultation - technical issues in charity law

The Law Commission has issued a consultation paper on 'technical issues in charity law' as a result of their deliberations on Lord Hodgson’s 2012 review of the 2006 Charities Act (which has largely been republished in the current 2011 Act). The paper expresses the honourable aims of clarifying and simplifying the regulations that apply to charities and their trustees. However, other recent developments in the regulation of charities have not been so positive.
