Richard Frimston, partner in Russell-Cooke's private client team, and Patrick Delas of the French law team, will be key speakers at the forthcoming STEP and EU Commission cross-border tax conference in Brussels on 12 November 2012. Patrick will be delivering his expert views, with Richard chairing the conference that will also include several eminent speakers such as European Commissioner for Taxation and Customs Union, Audit and Anti-Fraud Algirdas Šemeta.
Too often, EU citizens find themselves subject to double or even triple inheritance taxation across EU borders. The conference will address current EU developments with regard to cross-border tax problems, and is being billed as the "Experts' response to the European Commission's proposals."
Richard comments: "'With increasing frequency, the European Court of Justice has held that the right to free movement of persons, goods, services and capital within the EU applies to limit the taxation rights of Member States.
'Inheritance has been found to be a movement of capital and many Member States governments have been forced to amend existing tax rules. In the case of Austria, this led directly to the abolition of gift and inheritance tax. As a result, the Taxation and Customs Union Directorate-General (TAXUD) of the EU Commission is looking at the effects of inheritance taxes on the rights of free movement.
'It is vital that practitioners actively participate in these discussions and help guide the EU on its approach to inheritance tax.'"
