Acting in a claim regarding a property, in the context of ancillary relief proceedings. We acted for the child of one former spouse, who had been gifted a property on trust before the couple divorced. The child had since reached majority and paid off the mortgage. As a result, the legal title to the property had also been transferred to him.
His mother's ex-husband sought to have the property considered as a matrimonial asset in relation to his claim for ancillary relief, in order to increase the value of the assets which were available for distribution. Fortunately for our client, the ex-husband was entirely unsuccessful in his application. Our client retained the property and, due to the conduct of the ex-husband, was awarded his costs on the indemnity basis.
