Lee Ranford and Jenny Raymond acted for Swindon Town FC in the Club's successful appeal against a decision of the High Court to refuse its application to strike out a winding up petition. The Club recovered costs, both in the appeal and from the original hearing in the High Court. 

The claim was brought against the Club by a former director Mike Diamandis. Although the claim was disputed, a petition to wind-up the Club was issued with potentially very serious consequences for the Club's future.

That application to strike out the winding-up petition which was opposed by Mr. Diamandis  was heard by the High Court at the end of June last year. Mr Justice Peter Smith found against the club.

The Court of Appeal, with the Master of the Rolls (Lord Neuberger) presiding, gave judgment yesterday. The Court agreed that there was persuasive evidence that a bona fide dispute in relation to each aspect of the claim had always existed.

We were very concerned that High Court's analysis was very different from our own and so it is particularly pleasing that the Court of Appeal accepted every aspect of our appeal"
