Matt Bosworth, a regulatory law partner, led an experienced team in advising and representing the Federation Against Copyright Theft (FACT) in bringing a prosecution on behalf of its member, Sky UK. It was alleged that Merlin Inns Limited and three of its employees had illegally shown Sky UK’s feed without paying the correct rate.
Merlin Inns Limited, based in Cranleigh, Surrey, pleaded guilty to ten offences at Redhill Magistrates Court on the 4 April 2016 and was fined £90,000 with additional costs in the sum of £28,500.
Three Designated Premises Supervisors (DPS) also pleaded guilty to a total of three offences and were each fined £600 with a victim surcharge of £60, bringing the total to a record sum of £120,600. This is the highest sum that any company has been ordered to pay by the Courts in relation to prosecutions under Section 297(1) of the Copyright Designs and Patents Act 1988.
