We are instructed by E, who is objecting to the registration of an Enduring Power of Attorney (EPA) purportedly made by her elderly mother, in favour of J, her sibling. It is not disputed that E and J's mother has lost the capacity to manage her property and financial affairs.

However, E is concerned that J unduly influenced their mother into signing the EPA at a time when she have lacked the capacity to do so. J has also recently attempted to register their mother's sole major asset in his own name and made withdrawals from her bank account for his own benefit. We are assisting E in objecting to J's application to register the EPA and are seeking that E is appointed as Deputy for her mother, so that she can investigate the transfer and cash withdrawals by J.
