We advised TM Eye Ltd against Mr Safdary for nine offences under the Trade Marks Act 1994 arising out of his selling and offering for sale counterfeit Louis Vuitton and Mulberry items at a market in London.
The defendant pleaded not guilty to the charges on the basis that he reasonably believed he was not infringing a registered trade mark. After a trial, the Court found the defendant guilty of all nine offences and sentenced him to a 12 month community order with the condition of 150 hours unpaid work.
