We are instructed by N with regards to an application made by her Deputy to the Court of Protection. The matter involves issues of whether N has the necessary capacity to make personal welfare decisions and has implications with regards to safeguarding her liberty.

Before our instruction medical evidence in the matter had been obtained from two experts and a joint statement obtained, which revealed that there was little agreement between the experts as regards to N's capacity.

We obtained the agreement of the parties and the Court to a further expert report and the filing of further witness evidence to set out N's capacity and her views as to the proposed treatment suggested.

N is awaiting the final hearing in her matter.
