An appeal to First Tier Tribunal against a Refusal to Statement (note in Lieu) following assessment for a child with complex needs - ADHD, ASD, Anxiety Disorder, ODD, Hyperacusis (sensitivity to noise).

In this case there was a significant difference of opinion between the experts and how the child's needs could be adequately met. Consideration of costs was also a central feature of this case.

Having favourably settled the decision with regard to statementing the Local Authority's refusal to accede to the parental preference for an independent specialist school then gave rise to a subsequent ongoing appeal.
