Appeal to First Tier Tribunal against Local Authority's refusal to assess a child with multiple complex needs including Aspergers, Developmental Coordination Delay, Sensory processing Issues.

In this case the Local Authority and the school maintained that despite the child's special needs the provision afforded at School Action Plus was sufficient. Eva Akins argued by way of reference to expert evidence that the child's needs were complex and needed further assessment in order to determine the appropriate provision.

Further that contrary to the position asserted by the Local Authority and supported by the school the child was in fact on detailed analysis of IEP's, school reports and school work that the child was not making any or anywhere near sufficient progress despite the support in place and therefore called for further provision to be determined.
