Acting for an owner of a property in a dispute regarding a property which he co-owned with a family member who lived in the property.  Our client was the non resident co-owner of a property, where it had been intended that his family member would live on a short term basis. 

After a number of years, our client needed to return to live in the property and sought to buy-out his co-owner (who had lived in the property rent free).  Fortunately, the beneficial interests of each party were clearly set out in a declaration of trust, which allowed a favourable settlement to be reached, and enabled our client to regain control of the property.
