• Our client applied for planning permission for 49 student accommodation units which was refused and then appealed, which then led to a contentious appeal process.
  • We successfully negotiated the section 106 agreement with the Council which included obligations detailing provisions as to who will occupy the units – the main reason for refusal was that there was no agreement in place with a university to occupy the units.
  • The Council eventually agreed to a detailed cascade mechanism we negotiated, which required the developer to endeavour to ensure occupation by students within the borough, and if not, the units could be offered to universities elsewhere.
