Understanding regulatory and public law

Expert regulatory and public law representation for high-stakes matters

Our specialist regulatory and public law team act in a variety of regulatory contexts and have extensive experience in public law, including judicial reviews in both regulatory matters and more broadly. We act for regulators, firms and individuals.

These situations are usually high stakes. We devise effective strategies to ensure that matters are resolved without the need for litigation where possible. We  have the expertise and resources to handle long and complex contested matters, such as those relating to investigations by the Solicitors Regulation Authority (SRA), Financial Conduct Authority (FCA), and HM Revenue and Customs.

How our regulatory and public law solicitors can help you

Our leading regulatory and public law team offers expert legal advice tailored to meet your specific objectives. We work as part of a multi-disciplinary full service firm and are able to draw on a wide range of expertise as required.

Our track record speaks for itself. We have acted for regulators and professional bodies for decades, including the Solicitors Regulation Authority, the Law Society, CILEx Regulation, the Architects Registration Board, the Chartered Institute of Management Accountants and the British Association for Counselling and Psychotherapy.

We have a strong defence practice, advising major City firms and individual professionals on regulatory issues, including the investigation of allegations of misconduct. Our clients include a number of City and national law and accountancy firms, and over 40 sets of barristers’ chambers. We defend teachers, doctors, opticians and other healthcare professionals.

We advise on the most serious allegations, cases with an international element and those with a high level of public and media interest requiring careful management of reputational risk.

Judicial reviews, equality act claims, and inquiry support

Our team provides advice to public bodies as well as those impacted by public body decisions.

Our work with public bodies often deals with both sustainable decision making systems and the appropriate approach to individual decisions.

This work has included judicial reviews of investigation and prosecution decisions, and decisions in respect of publication which raise Article 8 and Article 2 issues.

We act for individuals, charities and businesses who seek to bring judicial reviews in the High Court.

Our team also provides expert advice on Equality Act and Human Rights Act claims.  We bring discrimination claims in the County Court. We act in important and high profile cases, with the ability to offer reputation management advice in parallel.

We also advise on public inquiries. Examples include our ongoing work on the high-profile Grenfell Tower Inquiry and Infected Blood Inquiry.

We support the drafting of legal structures, statutory powers, royal charters, regulations and rules. We advise on the effect of European law, particularly the implications of Brexit, and data protection/freedom of information law.

Abroad base of experience, prosecuting and defending in front of a wealth of different regulators (and sports bodies), and with the nous and experience to transition seamlessly if the matters become criminal or there are civil proceedings that spin off.
