We have advised on several enforcement matters for parties trying to get Councils to use enforcement powers, and for parties trying to resist enforcement action or criminal prosecutions. We have successfully got Councils to take enforcement action and prosecute when enforcement notices were not complied with after previous long periods of inaction by the Council.
We acted for a private individual on an appeal against an enforcement notice to remove an outbuilding. A retrospective application for the same had been refused by the council and by the Planning Inspectorate. New and persuasive arguments were raised on the enforcement appeal that the Planning Inspectorate agreed that planning permission ought to have been granted.
