Property litigation

Expert guidance and support from trusted property litigation solicitors

Understanding property litigation

Here at Russell-Cooke, we know how complicated property disputes can be and can advise you on challenges that might arise.

Our team of specialist property litigation lawyers do more than just litigate. We work on an advisory basis with clients including private landlords, corporate investors, owners of prime residences and tenants. We work to resolve disputes related to commercial and residential property, enfranchisement/block management and housing, whether through mediation, ADR or in court.

How our property litigation specialists can help you

Our team of property litigation specialists acts for property owners, landlords and tenants (in the private and social sectors), institutions, charities, housing co-ops, tenant organisations and small to large businesses.

We advise property owners, landlords and tenants on a wide range of real estate disputes, including: disputes about ownership of, and interests in, property; disputes about the acquisition of property; disputes about contracts, leases and mortgages (including construction or interpretation), and misrepresentation.

We represent our landlord clients on landlord and tenant issues, repossession of property, including eviction of squatters and recovery of rent and service charges. We advise on business tenancy disputes, dilapidations and disrepair claims, rent reviews, rights of way and rights of light and party wall and boundary disputes, and act for both private and corporate occupiers.

Our approach to property litigation

We have been involved in many high-profile cases over the years. Our recent work has included litigation and advisory work relating to  commercial property with clients including retailers and the third sector. This involved business tenancies renewals, termination, high value disrepair and dilapidations. We are active in the private rented and build to rent sectors for major institutional and corporate players including recent disruptors and those in the growing student accommodation sector. We have equal experience acting for high net worth individuals who encounter property issues.

Our dedicated social housing team handles legal aid work for social housing tenants but are as comfortable defending possession claims and bringing judicial reviews against housing authorities. They advise on the ongoing Grenfell Tower inquiry. Related to issues arising from the inquiry we have further specialists in cladding and building safety remediation disputes.

Finally we offer expertise on all issues relating to block management and enfranchisement.
