We acted for a Claimant alleging that her parents' wills were mutual (binding) wills and that consequently her father could not after her mother's death, transfer the property subject matter of the wills to a third party. If the wills were so binding, this would have had repercussions in that the third party held the property on trust for the father. The estate included assets in Cyprus and so this included consideration of whether the mutual will regime would apply in Cyprus where forced heirship rules apply.
