Represented a client who had been seen by police looking at his mobile telephone whilst sitting in traffic. He had been issued with a fixed penalty notice which he had complied with. However, the police lost the record confirming that the notice had been complied with and a summons was issued requiring our client to attend court.
We were able to persuade the court that this was an administrative error and not the fault of the client. He was sentenced to a £60 fine (the amount payable under the fixed penalty notice) and three points on his licence.
