Business interruption insurance (BII) and Covid-19 related claims under BII policies are topical at the moment as the FCA has been running a "test case", which it commenced after noting a lack of positive responses by insurers to claims relating to Covid-19 made under BII policies.
The aim was to help bring about clarity and guidance to the industry as to the type of BII policies under which insurers are and are not obliged to pay out under.
Judgement was handed down on 15 September 2020 and is good news for policyholders as the FCA was largely successful with arguments intended to widen coverage.
