Following an investigation by the Care Quality Commission (CQC) into Merok Park Nursing Home in Surrey, in December 2014 a decision was taken to close the home and re-allocate residents. Please see our previous article for full details.
On 12 February 2015, the CQC published their full inspection report, a 21 page document outlining countless failings and poor management of Merok Park Nursing Home. The report concluded that the home was inadequate in all five service areas, namely whether the service was safe, effective, caring, responsive and well-led.
A number of specific failings highlighted by the CQC in the inspection report include:
- "We found mould on walls, broken taps, stained carpets and only cold or tepid water coming from the taps in some people's rooms"
- "People had been unable to get downstairs for approximately one month when the lift was broken"
- "We observed staff being rough with people and ignoring people who were in distress. Staff did not treat people as though they mattered. One person said no one ever listened to them. Other people sat for long periods of time and staff did not acknowledge them."
Russell-Cooke is investigating the possibility of bringing civil proceedings in negligence on behalf of residents as well as potential claims for Human Rights Act violations and breaches of contract.
"This inspection report paints a picture of an unsafe and hostile environment unfit for purpose", commented Janice Gardner, partner in the personal injury and negligence team. "If you or your family were resident at Merok Park please contact us and we will be pleased to advise you of your legal rights and discuss with you any possible claim you may have. Don't suffer in silence; contact one of our specialist solicitors as soon as possible."
Russell-Cooke offers 'no win, no fee agreements' in suitable cases and also a free first meeting or telephone consultation.
