BM v Chelsea & Westminster Hospital NHS Trust
Nimmisha Aslam secured a £38,000 settlement for a 72 year-old woman after she suffered a fracture to her right clavicle during a right shoulder arthroscopic subacromial decompression.
The client underwent the surgery to repair a rotator cuff injury. As a result of the operation being performed negligently, she sustained an iatrogenic fracture of the clavicle and injury to the coracoclavicular ligament complex. Her airway and respiratory function was also compromised, requiring intubation and a night in ITU.
The client suffered from ongoing pain, functional limitation and weakness which would be permanent.
The case was settled on a global basis prior to issue of court proceedings with no particular breakdown of damages.
