Partner Gareth Ledsham has been quoted in an article from IFA Magazine on the legal and financial implications that can arise when death and divorce coincide. Gareth explores the potential consequences for wills, pensions, protection policies, jointly owned property and inheritance rights, while highlighting the role advisers can play in identifying risks and encouraging clients to seek legal advice during separation.
[It is] an opportunity to think about what situations could arise following the death of one of the partners. For example, it is possible to make a will and consider what reasonable financial provision would look like for the separating parties, and what the position of the children would be.
Death and divorce are each difficult enough on their own. When they coincide, the consequences can be unpredictable, expensive and distressing.
