Associate Tom Hopkins has responded to a reader who wrote to The Times Home Help column, enquiring about the legal and practical issues surrounding a single drainpipe serving four terrace houses, which is causing flooding on the reader’s property. Tom notes that neighbours may have legal rights to discharge water through the pipe, and that a practical solution is often the most effective approach.

You should check whether your neighbours have a legal right to discharge roof water through the pipe. This may be stated in the property deeds. If so, their use is lawful, and the deeds may also set out who pays for repairs.
