Adjudication—what’s to be done? An ANB responds—Building

Consultant Robert Stevenson has written an article for Building addressing the recent steps taken by TECSA (Technology and Construction Solicitors’ Association) in response to concerns from adjudication users about adjudicator nominating bodies. In the piece, Robert outlines key measures implemented by TECSA to deal with the concerns regarding competence and decision-making, including increased transparency through the publication of adjudicators’ names and CVs, raised admission standards for new panel members, ongoing assessments of adjudicator performance, and a feedback and complaints process for parties. 

TECSA agrees with Tony Bingham that adjudicators should face tough exams and meet continuing training requirements, and it has implemented these steps. It also has other measures in place to ensure adjudicator quality. In addition, it requires undertakings to be given to avoid perceptions of bias.
