
Costs budgeting: burden, discipline and reform—Solicitors Journal
In an article published in the Solicitors Journal, associate Kirsty Manley explores the ongoing challenges and reforms surrounding costs budgeting in civil litigation, over a decade after the Jackson Reforms sought to make the process more proportionate and efficient.
She outlines the key rules under CPR 3.12–3.18, common pitfalls such as unrealistic budgets, late filings, and departures from approved figures, and the courts’ strict approach to enforcing proportionality. Practical guidance is given on drafting clear assumptions, engaging early with opponents, maintaining records, and managing client expectations. Kirsty also highlights the 2025–2028 Costs Budgeting Pilot Scheme, which introduces simplified procedures aimed at reducing administrative burden for lower-value cases.
Though cost budgeting is often seen as onerous and overly complicated, it remains a chance for solicitors to show professionalism, planning, and proportionality — a well-prepared budget can still provide strong protection.
