
Russell-Cooke acts in reported Hague Convention case concerning conditional return of children to Mauritius
Senior associate Natasha Kirk in the children law team has acted for an applicant father in a recent case concerning the summary return of young children to Mauritius.
Natasha instructed Ralph Marnham of 4PB in the proceedings and successfully sought the return of the children to their country of habitual residence following a wrongful retention.
The case is an example of a ‘conditional’ return order, where the return of the children is predicated first on the directed protective measures being registered in Mauritius.
This case is a prime example of the court balancing the objective of the 1980 Hague Convention - namely to protect children from the harmful effects of wrongful removal/retention - with the need to ensure children are not subject to grave risk of harm on their return home.
