The need to know for new directors—Estate Agent Today
Partner Shabnam Ali-Khan and trainee Kerrina Gray have co-authored an article for Estate Agent Today explaining how the Right to Manage (RTM) empowers leaseholders to take control of their building’s management, offering greater transparency and accountability while introducing significant legal and financial responsibilities.
The article outlines how the Right to Manage (RTM) allows leaseholders to take control of building management without buying the freehold, explaining that RTM companies assume duties such as maintenance, service charge collection, and enforcing lease terms, while landlords retain certain legal responsibilities. Directors must manage finances, approvals, and compliance with safety and data laws. Though demanding, effective RTM management can improve transparency, accountability, and community trust within buildings.
For many leaseholders who are unhappy with the management of their building, it is a good option and a serious contender to trying to obtain the freehold of the building... Leaseholders no longer feel powerless in the face of unexplained service charge hikes or delayed maintenance. With RTM, control passes directly into the hands of those who live in, and care about, the building, although there is no need to be resident in the building to take part in the RTM.
